Rentagun.com – Terms of Use

1. Overview and Agreement to Terms

These Terms of Use (“Terms”) are a legally binding agreement between you (“Renter”) and Rentagun.com (“Company”), governing your rental of firearms and related accessories from the Rentagun.com platform. By accessing or using this Site, you confirm that you are of legal age to enter into this agreement and are not prohibited by law from renting or possessing firearms. Use of the Site constitutes acceptance of these Terms, our Privacy Policy, and all applicable laws.

2. Definitions

‘Renter’ refers to any individual who initiates a rental transaction through Rentagun.com. ‘Rental Period’ is defined as the period beginning either (a) at the time the Renter picks up the Product from the designated FFL Dealer, or (b) 48 hours after delivery to the designated FFL Dealer—whichever occurs first, and ending one business day after the scheduled end rental date to allow for customer return. ‘Product’ refers to any firearm, accessory, or item made available for rent on the Rentagun.com Site. ‘FFL Dealer’ refers to a licensed firearms dealer authorized to transfer firearms to renters in accordance with federal law.

3. Age Eligibility

Age Requirements

  • Shotguns & Rifles: Must be 18 years of age or older

  • Handguns: Must be 21 years of age or older

Additional restrictions may apply depending on state or local regulations.

Age & Eligibility Verification 

Rentagun.com does not verify age, identity, or firearm eligibility during online checkout.

All verification occurs in person at the receiving Federal Firearms License (FFL) dealer at the time of pickup. The renter must: present a valid government-issued photo ID (e.g., driver’s license), complete ATF Form 4473, and successfully pass any required federal, state, or local background checks

Eligibility is determined solely by the receiving FFL dealer and applicable law.

 

4. Background checks & Transfer denial

Rentagun.com is not responsible for a renter’s ability to pass: ATF Form 4473 review, NICS background check or any state-specific background check, as well as any local permit or licensing requirement

If a renter:

  • Misrepresents their age or legal eligibility

  • Fails or is denied during the 4473 or background check process

  • Lacks required permits or documentation

  • Is denied transfer by the FFL for any reason

Then Rentagun.com bears no responsibility, however a partial refund will be issued, minus:

  • $35 processing fee
  • Shipping charges (both directions)

  • FFL processing fees incurred

Important: It is your responsibility to understand and comply with all firearm laws in your jurisdiction before placing an order.

By placing an order, you acknowledge that:

  • Final eligibility is determined exclusively by the FFL dealer

  • Passing the 4473 and background check is the renter’s responsibility

  • A denial at pickup does not entitle the renter to a refund

Failure to qualify at the FFL does not shift liability to Rentagun.com. If you believe a denial occurred due to a genuine administrative error or mix-up, you may contact our support team for assistance. While we are happy to review the situation and help where possible, contacting support does not entitle you to a full refund.

5. Pickup, Use, and Return of Firearms

Renter agrees to:

  • Pick up rented firearms from the specified FFL Dealer within the designated pickup window;
  • Use the firearm only in lawful, safe environments such as shooting ranges or hunting areas where legally permitted;
  • Refrain from modifying or tampering with the rented firearm;
  • Return the firearm using the prepaid shipping label provided to an approved shipping location authorized for firearm returns.
    • Please Note: Firearms may not be returned through drop boxes or unstaffed locations. To locate the nearest approved return location, please visit the carrier’s website or contact Rentagun.com for assistance

 

Late Fees, FFL Transfer Fee Notice

All prices are listed in USD. Additional charges may include:

Late Return Fees: Daily rental rate charged for each overdue day.

    • Failure to return a firearm within one business day after the end of the Rental Period will result in a late fee equal to the firearm’s current daily rental rate for each day it is past due.
    • Late fees will continue to accrue until they equal the firearm’s full retail value, at which point no further charges will apply.
    • Responsibility for a return ends once the mail carrier scans the provided return label, at which point the Renter will not be held liable for additional late fees.

FFL Transfer Fees: a charge for transferring a firearm from one licensed dealer to another.

    • If you purchase or rent a firearm online or from an out-of-state seller, it must be shipped to a local Federal Firearms Licensee (FFL) for a background check and legal transfer.
    • Transfer fees vary by dealer and location, typically ranging from $20 to $50.
    • These fees are charged directly by the receiving FFL and are not Rentagun.com charges.

7. Damage, Loss, and Insurance

Renter Responsibility: The Renter assumes full responsibility and liability for all rented items for the duration of the Rental Period.

Optional Insurance (Covers Loss and Damage): To reduce financial risk, optional insurance is available at checkout at a rate of $1 per $100 of the firearm’s retail value (rounded up to the nearest dollar). When purchased, this insurance may cover loss, theft, and accidental damage to rented items. If the Renter declines insurance, the Renter remains fully responsible for all amounts assessed under this Section.

Loss, Theft, or Destruction: In the event of loss, theft, or destruction of any rented item:

  • the Renter must notify RentAGun.com and local law enforcement immediately; and

  • the Renter is responsible for the replacement value as determined by RentAGun.com.

Damage and Excess Wear. All firearms and accessories are inspected upon return. Normal cosmetic wear from ordinary use is expected and does not result in additional charges. If an item is returned with damage or excessive wear beyond normal use, the Renter may be charged. All firearms are safety-checked before being returned to the rental inventory. Where significant damage is found, damage charges will be calculated as a percentage of the firearm’s MSRP, ranging from not less than 10% and not more than 90%.

 

8. Liability, Indemnification, and Disclaimers

a. Renters assume full responsibility for the lawful, proper, and safe use of any firearms or accessories rented from Rentagun.com.

b. Firearms are inherently dangerous tools. Rentagun.com is not responsible for any injuries, death, or property damage resulting from the use or misuse of rented firearms during the rental period, regardless of whether the firearm malfunctions or the incident is caused by operator error or negligence.

c. The renter agrees to use the rented firearm only in approved locations and under conditions consistent with safe firearm handling and legal regulations. Improper use includes, but is not limited to, unauthorized modifications, disassembly, reckless discharge, use under the influence of drugs or alcohol, and use in unlawful or unapproved areas.

d. In the event of injury or death during the rental period involving a rented firearm, the renter and/or their estate agree to indemnify, defend, and hold harmless Rentagun.com, its affiliates, officers, employees, and partners from and against any and all claims, damages, liabilities, costs, or legal actions arising directly or indirectly from such incidents.

e. The renter affirms that they understand and accept the risks associated with firearm use and explicitly releases Rentagun.com from any and all liability for physical or psychological injury, death, or property damage that may occur during or resulting from the rental period.

f. Rentagun.com strongly encourages renters to seek professional firearm training and to carry personal liability insurance.

9. Legal Compliance and Restrictions

Renter represents that they:

  • Are not under indictment or convicted of a felony or domestic violence offense;
  • Are not subject to restraining orders involving intimate partners or children;
  • Have not been adjudicated as mentally incompetent or involuntarily committed;
  • Will comply with all federal, state, and local firearm laws.

Non-compliance voids this agreement and may result in criminal penalties.

We do not ship to:

  • States with mandatory waiting periods longer than the rental term (e.g., California)
  • Locations with feature-based bans (e.g., certain rifles in NJ or NY)
  • Customers lacking required state permits (e.g., FOID in Illinois)
  • P.O. Boxes or APO/FPO addresses

Our system automatically filters restricted inventory based on your ZIP code. If your location has specific legal constraints, you may not be able to check out with certain products.

10. Termination and Enforcement

Rentagun.com reserves the right to terminate any rental or access to its services if these Terms are violated. In such cases, any unpaid fees remain due and legal remedies may be pursued. Renter grants permission for Rentagun.com to collect unpaid balances via third-party collections if needed.

11. Dispute Resolution and Governing Law

These Terms are governed by the laws of the State of Kentucky. All disputes shall be resolved by binding arbitration in Nicholasville, KY under the American Arbitration Association rules. No party may join or consolidate claims or arbitrate as a representative or class member. This arbitration clause is enforceable under the Federal Arbitration Act.

12. Changes to Terms

Rentagun.com may update these Terms at any time without notice. Continued use of the Site or services constitutes acceptance of any modifications. It is the Renter’s responsibility to review these Terms periodically for updates.
